EATZZA's text messaging program (the "Program") sends recurring marketing and informational text messages to subscribers who have opted in. Messages may include:
By providing your mobile phone number and submitting our signup form (clicking "Slice me in!" or any similar opt-in mechanism), you expressly consent to receive recurring automated marketing text messages from EATZZA at the mobile number provided, sent using an automatic telephone dialing system or similar technology.
Message frequency varies based on your engagement and our communications schedule. You may receive messages related to your account, orders, and ongoing marketing campaigns.
Message and data rates may apply. Standard messaging rates from your wireless carrier will apply to all messages sent to or from your mobile device. EATZZA is not responsible for any charges incurred from your wireless carrier. Check with your carrier for details on your messaging plan.
After you text STOP, you will receive one final confirmation message acknowledging your opt-out. You will not receive any further marketing messages unless you opt in again. Operational messages related to active orders may still be sent as needed.

You agree to notify EATZZA of any changes to your mobile phone number by updating your account or emailing yum@eatzza.com. You are responsible for any messages sent to a phone number that you have transferred or relinquished. If you transfer your mobile phone number to another person, you must opt out of the SMS program before the transfer.
The information we collect through the SMS program is handled according to our Privacy Policy. We do not share, sell, or rent your mobile phone number or message content to third parties for their marketing purposes.
We may share your mobile phone number with service providers that assist us in delivering messages (such as our SMS platform provider). These providers are contractually required to use your information only to provide the services to EATZZA.
EATZZA makes reasonable efforts to deliver messages in a timely manner. However, message delivery depends on factors outside our control including your wireless carrier, network conditions, and device settings. EATZZA is not responsible for:
THE SMS PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EATZZA DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, EATZZA SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR PARTICIPATION IN THE SMS PROGRAM, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
EATZZA reserves the right to modify or terminate the SMS program at any time, with or without notice. We may also modify these SMS Terms at any time. Material changes will be communicated through the Program or via email. Your continued participation after such changes constitutes acceptance of the modified terms.
These SMS Terms are governed by the laws of the Commonwealth of Kentucky. Any disputes related to the SMS program shall be resolved according to the dispute resolution provisions in our Terms of Service, including binding individual arbitration.
