Welcome to EATZZA. These Terms of Service ("Terms") govern your access to and use of the EATZZA website, mobile application, and related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms. Please read them carefully.

1.Acceptance of Terms

By accessing or using the Services, joining our waitlist, creating an account, or purchasing any product from EATZZA, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

You must be at least 18 years old to create an account or make a purchase. By using the Services, you represent that you meet this age requirement.

Product Descriptions and Availability

We strive to display our products accurately, including ingredients, preparation methods, and appearance. However, actual products may vary slightly from photographs. EATZZA reserves the right to limit quantities, refuse orders, or discontinue products at any time without prior notice.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, shipping fees, or other charges, which will be calculated at checkout and disclosed before you complete your purchase.

Payment

By placing an order, you authorize EATZZA to charge your selected payment method for the total amount of your order, including any applicable taxes and fees. We accept major credit cards and other payment methods displayed at checkout. All payment processing is handled by secure third-party providers.

Subscription Services

If you enroll in a subscription service (such as monthly pizza delivery or Founders Club membership), you authorize EATZZA to automatically charge your payment method at the agreed-upon intervals. Subscriptions continue until cancelled by you. You may cancel anytime through your account or by contacting yum@eatzza.com. Charges are non-refundable for partial subscription periods unless required by law.

Community Voting and Threshold Orders

EATZZA may offer products through a community voting and threshold-funded production model. When you commit to a vote-based order:

EATZZA ships products to addresses we are able to serve. Shipping availability is determined by your delivery address and current operational capacity. We will inform you of shipping options and estimated delivery times at checkout.

EATZZA is not responsible for delays caused by carriers, weather, customs, incorrect addresses provided by you, or circumstances beyond our reasonable control. If your order arrives damaged, melted, or in unsatisfactory condition, contact us at yum@eatzza.com within 48 hours of delivery and we will work with you to make it right.

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY APPLICABLE LAW.

While we make every effort to accurately describe ingredients and allergens, our products are produced in a facility that handles wheat, dairy, eggs, tree nuts, and other common allergens. If you have a food allergy or dietary restriction, please review ingredient information carefully and consult with your healthcare provider before consuming our products.

11.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EATZZA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF EATZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EATZZA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO EATZZA IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12.Indemnification

You agree to indemnify, defend, and hold harmless EATZZA, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) your User Content.

13.Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute arising from these Terms or your use of the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You and EATZZA agree that any dispute shall be brought in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

30-Day Opt-Out: You may opt out of this arbitration provision by sending written notice to yum@eatzza.com within 30 days of first agreeing to these Terms, including your name, address, and a clear statement of your intent to opt out.

14.Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be filed in the state or federal courts located in Fayette County, Kentucky.

15.Changes to These Terms

EATZZA may update these Terms from time to time. We will notify you of material changes by email or through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

16.Termination

EATZZA may suspend or terminate your account or access to the Services at any time, with or without notice, for any reason including violation of these Terms. You may close your account at any time by contacting yum@eatzza.com.

17.Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and EATZZA regarding the Services.
